Terms of Service

1. Operator and scope

The service is operated by an individual under the trading name ToMoshiMoshi. Contact: contact@tomoshimoshi.com. The operator's legal name and address are available on request at this email address and will be provided without delay; no account is required. These terms apply to the website, account, and calling features. The Privacy Policy explains personal-data processing.

2. Your account

You must be at least 18 and legally able to use the service. Provide accurate information, protect your account, and notify us of unauthorized use. Only act for someone else when you have the necessary authority and permission to use their information. Access to live calls may require a complete profile, verified email, sufficient credit, and available service capacity.

3. Call authorization and your decisions

A call starts only after you submit and authorize the request. Check the recipient, objective, information to share, and limits before submitting. Permission to share your saved profile is separate for each call. Text you include in a request may be used during the conversation even if profile sharing is off.

The assistant is designed to disclose that it is AI, ask the recipient to continue, and ask you about missing information or commitments outside your instructions. Stay available to answer and review the result. You can request that a call end; provider delays may affect when it actually disconnects. A reservation or other arrangement depends on the recipient's confirmation and their own conditions.

4. AI and service limitations

AI speech, interpretation, translations, and summaries can be incomplete or wrong. Verify important names, dates, amounts, instructions, and bookings with the recipient. We do not guarantee that a call connects, that a business agrees to a request, or that a transcript is exact.

Do not use ToMoshiMoshi for emergency calls, diagnosis, medical treatment decisions, or professional legal or financial advice. It is not an emergency service or a substitute for a qualified professional. Service may be interrupted by maintenance, network conditions, provider outages, or safety controls.

5. Acceptable use

Do not use the service for fraud, impersonation, harassment, unsolicited bulk calling, unlawful recording or disclosure, threats, or any unlawful purpose. Respect recipients who decline the call. Do not bypass security, misuse another person's account, or submit material you have no right to use. You remain responsible for having the permissions required for the request you submit.

6. Credit, prices, and payments

ToMoshiMoshi sells prepaid calling credit in Japanese yen through Stripe Checkout. The packages are ¥1,000, ¥2,000 and ¥5,000; one paid yen adds one yen of credit. These are real, one-time purchases, with no subscription or automatic renewal. Credit does not expire, cannot be transferred, and cannot be withdrawn as cash. The displayed package amount is the total charged by ToMoshiMoshi; your bank may separately charge currency-conversion or other fees.

The current domestic Japan rate is ¥125 per connected minute, calculated using whole connected seconds with the final charge rounded up to a whole yen. A call reserves available credit and releases unused credit after settlement. Failed or unanswered calls without connected time incur no usage charge. Confirmation of provider timing may delay settlement. A rate already accepted for a call will not be changed retroactively.

Payment is authorized when you confirm it in Stripe. Credit becomes available after the server independently confirms successful payment; delayed payment methods can take longer. Closing Checkout or returning to the website is not proof of payment. If confirmation is pending, do not pay again for the same purchase; contact contact@tomoshimoshi.com with the transaction identifier.

We do not offer voluntary refunds for purchased credit, including unused balances or account closure. This does not limit refunds for billing errors, duplicate or unauthorized charges, failure to provide the purchased service, or rights required by applicable law. Contact support to request review. Approved refunds are returned through Stripe to the original payment method, subject to its processing times. Corresponding credit is removed or held; disputed payments may restrict further calls while reviewed. These restrictions do not remove your right to dispute a charge.

The Commercial Disclosure provides purchase, delivery, cancellation and contact information. Review it together with these terms and the Privacy Policy before confirming payment.

7. Content and privacy

You retain your rights in the information you submit. You authorize us and our service providers to process it only as needed to provide, secure, and support the requested service, as described in the Privacy Policy. You can request access or deletion through support. Third-party services such as Google Maps have their own applicable terms and privacy policies.

8. Suspension, closure, and responsibility

We may limit or suspend use to address abuse, security threats, legal requirements, or service failures. Where practicable, we will explain the reason and provide a way to contact support. You may stop using the service or request account closure at any time; the Privacy Policy explains retained records and deletion requests.

Each party remains responsible to the extent required by applicable law. These terms do not exclude liability that cannot lawfully be excluded, including protections relating to intentional misconduct or gross negligence, and do not waive mandatory consumer rights.

9. Changes and disputes

We may update these terms for changes to the service or applicable requirements. Material changes will be notified before they take effect where required. New charges or materially different paid services require the relevant purchase information and your agreement.

Japanese law governs these terms, subject to any mandatory protections that apply in your place of residence. No exclusive forum or mandatory arbitration is imposed here.
